Can I file for uncontested divorce?

You can file for uncontested divorce in Washington State if:

  1. You or your spouse have lived in Washington State for at least the past 6 months, or if one of you is a member of the military currently stationed in Washington.

  2. Your spouse will sign divorce papers without dispute.

  3. You’ve agreed on how you’ll divide all property and liabilities, including debt.

  4. If you are pregnant, have any children from this marriage or children for whom you’re both legal guardians, you’ve agreed on a parenting plan including custody, visitation rights, and spousal support.
